Kouvre Digital Card Terms and Conditions

These Digital Card Terms and Conditions (the "Card Terms") govern the issuance, usage, and deactivation of the digital loyalty cards (each, a "Digital Card") provisioned through the Kouvre mobile application (the "App"). By clicking "Join Now" or otherwise generating a Digital Card for a participating Merchant, you agree to these Card Terms.
These Card Terms are supplementary to the General Application Terms of Service, the Rewards Terms, and our Privacy Policy.
1. DEFINITIONS
"App" means the Kouvre mobile application and associated digital platforms.
"Digital Card" means the digital user interface element and scannable QR code generated within the App that uniquely identifies a Member's loyalty account with a specific Merchant.
"Kouvre" (also "we", "us", "our") refers to Kouvre Inc., a technology service provider based in Montreal, Quebec.
"Member" (also "you", "your") refers to a consumer who has registered an account on the App.
"Merchant" means an independent, third-party business that utilizes the App to host its loyalty program.
"Points" means the digital loyalty points tracked on the Digital Card.
2. NATURE OF THE DIGITAL CARD
2.1 Not a Financial Instrument: The Digital Card is strictly a digital loyalty identifier and a user interface (UI) feature designed to facilitate the scanning of a QR code at a Merchant's physical counter.
2.2 No Stored Value: The Digital Card is not a credit card, debit card, gift card, or prepaid card. It is entirely decoupled from any financial rails, payment processing systems, or monetary transfers. It holds no fiat currency, has no cash value, cannot be purchased, cannot be sold, and cannot be used to process payments for goods or services.
2.3 Exemption from Prepaid Card Regulations: Because the Digital Card holds no monetary value and requires no upfront payment to obtain, it is exempt from the regulations governing prepaid cards under the Consumer Protection Act (Quebec).
3. ISSUANCE AND COMPONENTS
3.1 Free Issuance: Members may obtain a Digital Card for a specific Merchant entirely free of charge by navigating to the Merchant's profile within the App and selecting "Join Now" (or equivalent prompt).
3.2 Card Components: Upon issuance, the App will automatically generate a Digital Card containing: (i) the Merchant's name; (ii) the Merchant's logo; (iii) the Member's registered name; and (iv) the Member's current Points balance with that specific Merchant.
4. USAGE AND NON-TRANSFERABILITY
4.1 In-App Ecosystem Only: Digital Cards live exclusively within the Kouvre App ecosystem. They cannot be exported, downloaded, or transferred to third-party digital wallets (such as Apple Wallet or Google Pay).
4.2 Non-Transferability: The Digital Card is issued to you personally. You may not digitally share, assign, sell, or transfer your Digital Card (or a screenshot of its QR code) to another Member's account.
4.3 Device Sharing: While Digital Cards are non-transferable, Kouvre and its Merchants recognize that a Member may physically permit a friend or family member to present the Member's mobile device at a Merchant counter for scanning. The Member remains solely responsible for all activity, Point accumulation, and Point redemptions that occur when their device is scanned.
5. ACCOUNT RECOVERY AND DEVICE LOSS
5.1 App Deletion vs. Account Deletion: Merely deleting the Kouvre App from your mobile device does not delete your account or destroy your Digital Card(s).
5.2 Recovery: If you lose your mobile device or delete the App, you may recover your Digital Card(s) and associated Points by reinstalling the App and authenticating your account using your original registration method (e.g., email verification, Apple Sign-In, or Google Sign-In).
6. DEACTIVATION AND EXPIRATION
6.1 Inactivity Expiration: Similar to the Points tracked upon it, a Digital Card associated with a specific Merchant will expire and be deactivated if your account with that Merchant remains completely inactive (no earning or redeeming) for a period of twelve (12) consecutive months. As required by Quebec law, Kouvre will provide written notice 30 to 60 days prior to this deactivation.
6.2 Voluntary Account Deletion: If you formally request the deletion of your Kouvre account via the App's settings or by contacting Kouvre support, all associated Digital Cards will be permanently deactivated and destroyed, and any associated Points will be forfeited immediately.
7. PROHIBITED CONDUCT AND FRAUD
7.1 System Abuse: Any attempt to manipulate the App, artificially inflate Points balances, duplicate QR codes, or otherwise defraud Kouvre or a Merchant constitutes a material breach of these Card Terms.
7.2 Enforcement: In accordance with Quebec law, Kouvre reserves the right to immediately suspend or permanently revoke your Digital Card(s) and terminate your App access if we suspect fraudulent or illegal activity. Kouvre and its partner Merchants further reserve the right to pursue civil damages or refer matters to law enforcement for severe or coordinated fraud.
